On Wednesday, acting Westchester District Attorney James McCarty announced that Mount Vernon resident Garth O’Neil Cole has pleaded guilty to a felony count of second-degree criminal possession of a weapon for his role in the shooting that left Nolan dead.

Last week, Cole’s three accomplices in the shooting - Bronx residents Nashaun Hunter, Tejmitra Singh and Darren Dawson - pleaded guilty to various violent felony charges. Cole was initially charged with two counts of criminal possession of a weapon and assault before pleading down.

Shortly after 12:30 a.m. on Sept. 18 last year, Nolan was standing outside of his Mercedes in the parking lot at the Burger King on Central Park Avenue when six shots rang out of the Toyota Camry being driven by the four defendants, with one of the bullets hitting Nolan in the head.

Nolan was rushed to Jacobi Medical Center in the Bronx, where he was put into a coma before being declared dead on Oct. 9.

The Yonkers Police Department and Westchester County District Attorney’s office launched an investigation that determined that the shooting was “in retaliation for the beating of an individual known to the suspects and related to events that took place during a drag race two nights prior.”

“The allegations in the indictment are frightening,” McCarty stated. “It’s alleged that Nashaun Hunter aided and abetted by Garth O’Neil Cole, Darren Dawson and Tejmitra Singh piled into a car and drove to a fast food restaurant at which point the car they were in slowed so that Hunter could fire six shots and kill Michael Nolan, an innocent young man with a promising future.”

The four defendants all remain remanded to the Westchester County Jail. Hunter, Singh and Dawson are scheduled to be sentenced on Wednesday, Oct. 12. Cole will be sentenced on Thursday, Dec. 1.
