Duo Busted For DWI, Cocaine Possession During Westchester Stop, Police Say

A traffic stop of a motorist driving without lights late at night led to a pair of misdemeanor charges for one man and a drug charge for another in Scarsdale over the weekend police said.

While conducting DWI traffic enforcement on Post Road at approximately 4 a.m. on Saturday morning, a Scarsdale Police officer stopped White Plains resident Edwin Roberto Tonato, 33, for traveling without headlights on.

As the officer approached the vehicle, he reported that both Tonato, and his passenger, White Plains resident Jose Vidal, 34, “began making excessive movements in the vehicle. As I approached the driver’s side window, I observed the passenger holding both his hands between his legs as if he was attempting to conceal something.”

According to police, Tonato had the smell of alcohol on his breath and when he was instructed to roll down his rear window due to its tint, he instead just kept moving the driver’s side window up and down. He proceeded to fail multiple Standardized Field Sobriety Tests, and an alco-sensor pre-screening test showed he had a blood alcohol content of .16 percent, double the legal limit. A breathalyzer at Scarsdale Police Headquarters showed that he had a blood alcohol content of .18 percent.

While Tonato was being arrested for driving while intoxicated, a search of his vehicle determined that Vidal was in possession of a small bag filled with a white powdered substance that is believed to be cocaine, police said.

Tonato was charged with misdemeanor counts of driving while intoxicated and aggravated driving while intoxicated with a blood alcohol content greater than .18 percent. Vidal was charged with seventh-degree criminal possession of a controlled substance.

After being processed, both men were released on their own recognizance and each is due back in Scarsdale Village Court on Wednesday, May 16 to answer the charges.
