A Bronx grand jury is currently hearing the case against the men, Garivaldi Castillo and Julio Salcedo Contrer, to consider charges of assault and criminal possession of marijuana, said Patrice O'Shaughnessy, spokeswoman for the Bronx DA's Office.
"The investigation is continuing, the crime scene is still active, and there could be additional charges when it is completed," she added.
Fahy, 44, a North Rockland native and 17-year member of the city fire department, was killed by a piece of roof that blasted through the air in the explosion at a home in the Kingsbridge section of the Bronx where firefighters had discovered a marijuana growing operation, authorities said.
Others injured included six police officers, nearby residents and utility workers, they said.
Authorities are investigating whether the explosion was the result of someone in the home, where Contrer lived, had tampered with the gas line.
