A&P Receives Bids For 17 Westchester Stores

WESTCHESTER COUNTY, N.Y. -- A&P has received bids for 17 of its stores in Westchester County, according to its Chapter 11 federal bankruptcy court filing.

Fifteen of the bids are from Acme Markets, Inc., which is a division of Albertsons Companies, Inc. Stop & Shop, which is a subsidiary of Dutch food-service company Ahold, placed a bid for the Mount Kisco location, while Key Food is bidding on the Harrison store.

All of the Westchester stores with bidders lined up operate under the company's eponymous A&P brand name.

The stores are among 120 that A&P has secured bidders for. The companies are called stalking horse bidders, which means that they will acquire the stores if no competing bidders emerge.

A&P's auction timeline includes a Sept. 11 deadline for bidders to file binding offers. Bidders who meet certain criteria will earn "qualified" bid status, making them eligible to go forward with the auction, according to the bankruptcy filing. There is a Sept. 18 deadline to publish qualified bidders. If there are competing bidders, auctions will be held on Sept. 24 to 25, with a hearing to follow on Oct. 1. If no qualified bidders emerge, the hearing will be on Sept. 22.

Meanwhile, the fate of seven Westchester stores is unknown, although the company intends to sell those that currently do not have bidders. The stores are among 176 not linked to a buyer.

The terms set forth in A&P's filing call for bidders to bid for clusters of stores that correspond to the stalking horse bidders' packages. The Mount Kisco store is an exception, as it can be bid for separately without strings attached.

A&P's bankruptcy court filing can be read here. The list of stores with bidders is on pages 75 to 79.

The potential expansion would be a significant addition for Acme and for Albertsons. The parent company is also in the process of going public, having submitted a regulatory filing earlier this month. The filing can be read here while related documents are available here.
